Tweets Can Get You Fired

If You Are an Employee At Will, Then You Can Be Fired in Retaliation for Tweeting About Your Employer

This weekend, I read an excellent article authored by Philadelphia Inquirer columnist Jane M. Von Bergen, entitled "How Tweeting About Your Boss Can Get You Canned."

A few years ago, a similar issue surfaced concerning Facebook postings.

Here are some things to bear in mind:

*  If you are an employee at will, you can be fired for any reason, including things that you do while off of the clock.

*  If you are fired for off-duty conduct, you can in most cases get unemployment in Pennsylvania, unless the action you engaged in was highly inflammatory or illegal.

If You Are an At Will Employee, You Can Be Fired for What You Do on Your Personal Time on Your Home Computer or Cell Phone

If you are an at will employee, employers do not need a "good" or "legitimate" reason to fire you.  In fact, they can fire you for no reason at all.

If You Are Terminated For What You Did at Home While Off the Clock, You Will Not Have a Claim for "Wrongful Termination"

In such situations, the best you can do its to win an unemployment claim for benefits. Unemployment benefits are THE ONLY remedy for employees who lose their jobs for no reason or for a weak reason.
